1. Definitions

In these Terms & Conditions, the following terms carry the meanings assigned below:

  • "Agreement" means these Terms & Conditions together with any service engagement letter or written scope of work agreed between the parties.
  • "Content" means all text, photographs, documents, reports, and other materials published on or made available through the Website.
  • "Services" means the residential advisory services offered by Permata, including Considered Residence Sourcing, Lease Review & Tenancy Coordination, and the Long-Stay Residence & Concierge Programme.
  • "User" means any individual who accesses or uses the Website, whether or not they engage the Services.
  • "We", "Us", "Our" means Permata Advisory Sdn. Bhd., registered in Malaysia and operating from Persiaran Hampshire, 50450 Kuala Lumpur.
  • "Website" means the website operated by Permata at its registered domain and any subdomains associated with it.
  • "You", "Your" means the User or client engaging with the Website or Services.

2. Acceptance of Terms

By accessing the Website or requesting any of the Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of an organisation, you further confirm that you have authority to bind that organisation to these Terms.

Continued use of the Website after any revision to these Terms constitutes acceptance of the updated version. Where a formal service engagement letter is issued, that document and these Terms form the complete Agreement between the parties.

3. Service Description

Permata offers residential advisory services to individuals and families seeking apartments and townhouses within Kuala Lumpur's settled residential districts. Our Services are described in detail on the Website and include:

  • Considered Residence Sourcing (RM 2,380) โ€” a measured, adviser-led process of identifying and presenting a carefully edited shortlist of residential options suited to the client's stated priorities.
  • Lease Review & Tenancy Coordination (RM 4,950) โ€” professional review of tenancy documentation, verification of ownership, and coordination of handover matters with the property manager.
  • Long-Stay Residence & Concierge Programme (RM 10,500) โ€” a comprehensive arrangement covering sourcing, lease coordination, move-in setup, ongoing property liaison, and related concierge matters across a multi-year tenure in Malaysia.

All Services are provided in English and are intended for clients seeking residential accommodation in Kuala Lumpur, Malaysia. Geographic scope may be discussed at the time of engagement.

4. User Responsibilities

In using the Website and Services, you agree to:

  • Provide accurate, complete, and current information when submitting enquiries or engaging Services.
  • Not use the Website for any unlawful purpose or in any manner inconsistent with these Terms.
  • Not reproduce, distribute, modify, or commercially exploit any Content from the Website without prior written consent from Permata.
  • Not transmit unsolicited commercial communications, interfere with the Website's operation, or attempt unauthorised access to any part of the Website.
  • Promptly inform us of any change in your circumstances that may affect the scope or suitability of the Services being provided.

We reserve the right to decline or discontinue Services where information provided is found to be materially inaccurate or where conduct is inconsistent with the professional and considered nature of our engagement.

5. Intellectual Property

All Content published on the Website โ€” including written descriptions, advisory notes, photographs, and design elements โ€” remains the intellectual property of Permata Advisory Sdn. Bhd. or its licensed contributors. No Content may be reproduced, published, or distributed in any form without prior written authorisation.

You are granted a limited, non-exclusive, non-transferable licence to access and view the Website and its Content for personal, non-commercial purposes only. This licence does not extend to downloading, printing at scale, or redistributing Content.

Any materials prepared for you in the course of a service engagement โ€” such as shortlist reports, tenancy summaries, or advisory notes โ€” are provided for your personal use in connection with the relevant engagement and may not be reproduced or shared without our consent.

6. Payment Terms

Service fees are denominated in Malaysian Ringgit (RM) and are payable as set out in the service engagement letter issued to you. Standard payment terms are:

  • A deposit is required prior to commencement of work, as specified in the engagement letter.
  • Remaining fees are payable at the milestones or stages agreed in the engagement letter.
  • Accepted payment methods include bank transfer to the account details provided in the engagement letter.
  • Fees are non-refundable once work has commenced unless Permata is unable to deliver the agreed scope through no fault of the client.
  • Any request to expand the agreed scope of work may require a revised fee, which will be discussed and agreed in writing before additional work proceeds.

If you have questions about fees or payment arrangements, please raise them before engagement commences. We are happy to discuss terms at the enquiry stage.

7. Service Engagement Terms

Each service engagement at Permata begins with a written confirmation of scope. The following principles apply across all Services:

  • Scope. Work will be carried out as described in the engagement letter. Any material change to scope requires written agreement from both parties.
  • Timelines. We work at a considered pace suited to the nature of residential advisory work. Where specific timelines are agreed, they will be noted in writing. We are not liable for delays caused by third parties, including property managers, landlords, or government offices.
  • Confidentiality. Information you share with us in the course of an engagement is treated with discretion and is not shared with third parties except where necessary to carry out the Services (for example, coordinating with a property manager on your behalf).
  • Third-party relationships. Permata acts as an adviser to you. We do not act as agent for any landlord, property developer, or real estate platform, and we do not receive referral fees from property owners in connection with our advisory Services.
  • No binding property decisions. Advice and recommendations provided by Permata are advisory in nature. All property and lease decisions remain your own, and we encourage careful independent consideration before committing to any tenancy.

8. Disclaimers

The Website and its Content are provided in good faith for informational purposes. While we take care to ensure accuracy, we make no representation that information on the Website is complete, current, or free from error.

The Services represent professional advisory assistance; they do not constitute legal, financial, or investment advice. Clients are encouraged to seek independent legal counsel before signing any tenancy agreement.

Permata does not warrant that the Website will be available at all times or free from technical interruptions. We shall not be liable for any loss or inconvenience arising from temporary unavailability of the Website.

Residential market conditions in Kuala Lumpur are subject to change. Any information about availability, pricing, or lease terms reflects conditions at the time of preparation and may not remain accurate over time.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Permata's liability to you in connection with the Website or Services โ€” whether in contract, tort, or otherwise โ€” is limited to the fees paid by you for the specific service engagement to which the liability relates.

Permata shall not be liable for:

  • Indirect, consequential, or incidental loss of any nature.
  • Loss of profits, business, or opportunity.
  • Loss or damage arising from reliance on third-party information, including property listings, landlord representations, or government records.
  • Delays or failures attributable to events beyond our reasonable control, including force majeure events such as natural disasters, civil unrest, or regulatory changes affecting the property market.

Nothing in these Terms limits our liability for fraud, fraudulent misrepresentation, or any matter that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Permata Advisory Sdn. Bhd., its directors, advisers, and staff from and against any claims, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms.
  • Inaccurate or misleading information provided by you in connection with a service engagement.
  • Your use of the Website in a manner inconsistent with applicable law or these Terms.

11. Termination

Either party may terminate a service engagement by written notice. The following applies upon termination:

  • Fees for work completed to the point of termination remain payable.
  • Where termination is initiated by Permata without cause, fees paid in advance for work not yet performed will be refunded on a pro-rata basis.
  • Where termination is initiated by the client, fees paid are generally non-refundable for work already commenced, in accordance with the engagement letter.
  • Provisions relating to intellectual property, confidentiality, limitation of liability, and dispute resolution survive termination of the Agreement.

We reserve the right to suspend or terminate access to the Website for any user found to be in breach of these Terms.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have jurisdiction over any dispute arising from or relating to these Terms or the Services.

In the event of a dispute, both parties agree to first attempt resolution through good-faith discussion. Should informal resolution not be achieved within 30 days of written notice of the dispute, either party may refer the matter to mediation under the Malaysian Mediation Centre before commencing formal legal proceedings.

Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction where circumstances warrant.

13. General Provisions

  • Entire Agreement. These Terms, together with any written engagement letter, constitute the entire agreement between the parties with respect to the subject matter and supersede all prior discussions and representations.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver. Failure by Permata to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision on any subsequent occasion.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Permata may assign its rights and obligations as part of a business restructure or transfer with reasonable notice to affected clients.
  • Notices. Formal notices under these Terms should be sent in writing to the address or email provided in the engagement letter. For general enquiries, [email protected] is available.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. Material changes will be communicated by posting an updated version on this page with a revised Last Updated date. We encourage you to review these Terms periodically.

Continued use of the Website or Services after the effective date of any change constitutes acceptance of the updated Terms. For active service engagements, we will notify you directly of any changes that affect the terms of your engagement.
